TERMS OF SERVICE

These Terms of Service ("Agreement") constitute a legally binding contract between Major Scale Painting ("Company," "we," "us," or "our") and any visitor, user, or customer ("you" or "Customer") who accesses our website (https://majorscalepainting.com/home) or schedules services through our Company. By using our website or booking a service, you agree to be bound by this Agreement. If you do not agree, please do not use our website or services. Individuals under the age of eighteen (18) are not permitted to use our website or book services.

We reserve the right to amend or update this Agreement at any time. Continued use of our website or services constitutes acceptance of any changes.


I. Services

Major Scale Painting provides professional residential interior painting services for homeowners in Atlanta, Georgia and surrounding communities. Our services include but are not limited to:

  • Living room, dining room, and common area painting

  • Bedroom painting

  • Kitchen and bathroom painting with moisture-resistant finishes

  • Trim, door, and ceiling painting

  • Single room refresh

  • Whole-home interior repaint

  • Premium interior packages including color consultation and detailed finish work

  • Surface preparation including cleaning, patching, sanding, and priming

  • Final walkthrough and touch-up on every completed project

All services are performed as listed on our website or as agreed upon between Major Scale Painting and the Customer at the time of the estimate.


II. Free Estimates

Free estimates are provided at no charge and with no obligation to proceed. During the estimate, we assess the scope of your project, discuss color and finish preferences, and provide a clear breakdown of what is included, what the job costs, and how long it will take. No work begins until you have reviewed and approved the estimate.


III. Quotes and Pricing

All quotes and estimates are based on the property details and scope of work provided at the time of the request. Final pricing may vary based on the actual condition of the surfaces, the number of coats required, scope changes, or additional areas identified during the project walkthrough. A quote is not a binding contract until both parties have agreed to the specific scope and pricing. Any additional work beyond the original scope will be discussed with and approved by the Customer before it is performed.


IV. Color and Finish Selection

The Customer is responsible for selecting and approving all paint colors and finishes before work begins. We offer color consultation as part of our Premium Interior Package and are happy to assist with color guidance on any project. We recommend reviewing paint samples on the actual surfaces to be painted before final approval, as colors may appear differently on walls than on swatches or screens.

Once painting has begun with Customer-approved colors, we are not responsible for color dissatisfaction resulting from the Customer's own selection. A repainting fee will apply if the Customer requests a color change after work has commenced.


V. Scheduling and Confirmation

Confirmation

Submitting a booking request or estimate inquiry online does not automatically guarantee an appointment for the selected date or time. A representative will contact you via phone, email, or text to confirm your project start date and timeline.

Customer Presence

The Customer or an authorized adult representative must be available at the start of the project to review the scope, provide access, and address any questions. The Customer is not required to be present throughout the workday but must be reachable by phone during working hours.

Project Timeline

Estimated project timelines are provided in good faith based on the scope of work at the time of the estimate. A single room is typically completed in one day. A full interior repaint of an average-sized home typically takes three to five days. Actual completion times may vary due to surface preparation needs discovered on-site, drying and curing times, or other conditions outside our control. We will communicate any timeline changes promptly.


VI. Customer Preparation

Prior to our team's arrival, the Customer is responsible for the following unless otherwise agreed in writing:

  • Removing or covering furniture, rugs, and personal belongings in areas to be painted

  • Removing wall hangings, artwork, mirrors, outlet covers, and switch plates

  • Ensuring pets are secured and not present in work areas

  • Providing clear access to all surfaces to be painted

  • Disclosing any known surface issues including water damage, mold, or structural concerns

Our team will use drop cloths and protective coverings to protect floors and remaining furnishings. We are not responsible for damage to items left in the work area that were not moved or disclosed prior to the start of work.


VII. Paint and Materials

Company-Supplied Materials

Unless otherwise agreed, Major Scale Painting supplies all paint and materials required to complete the job as quoted. Materials are selected based on the scope of work, surface type, and room environment. We use high-quality paints matched to each room's use and conditions.

Customer-Supplied Paint

If the Customer chooses to supply their own paint, the Customer assumes responsibility for ensuring the paint is appropriate for the surfaces being painted, is in sufficient quantity to complete the job, and is in usable condition. Major Scale Painting is not responsible for finish quality, coverage, or adhesion issues resulting from Customer-supplied paint. Workmanship warranties do not apply to work completed with Customer-supplied materials that are found to be defective.

Leftover Paint

Any leftover paint purchased by Major Scale Painting for the project remains the property of Major Scale Painting unless otherwise agreed. We will leave a labeled portion of each color for touch-up purposes upon request.


VIII. Payment

Payment Schedule

For single-room projects and smaller jobs, full payment is due upon completion of the work. For larger projects, a deposit may be required prior to the start of work, with the remaining balance due upon completion. Payment schedules will be confirmed at the time of the estimate.

Accepted Payment Methods

Payment may be made via credit or debit card, check, or other methods as confirmed at the time of booking. We accept all major credit and debit cards.

Financial Responsibility

You are personally and financially responsible for all outstanding fees and costs for services rendered. This includes any collection costs, attorneys' fees, and legal expenses incurred in the recovery of unpaid balances.


IX. Satisfaction Guarantee and Touch-Ups

We conduct a final walkthrough with the Customer upon project completion to review the finished work. Any touch-ups identified during the walkthrough will be addressed before our team departs or scheduled promptly at no additional charge.

Touch-up requests submitted within fourteen (14) days of project completion will be honored at no charge, provided the issues are related to the quality of our workmanship and not the result of normal wear, Customer modifications, or damage occurring after our departure.

We do not offer refunds on completed work, but we are committed to resolving legitimate workmanship concerns.


X. Right to Refuse Service

We reserve the right to refuse or discontinue service at any time and for any reason necessary to protect our team or ensure the quality of our work. Our representatives may decline to work in conditions that include:

  • The presence of mold, asbestos, lead paint, or other hazardous materials requiring specialized remediation

  • Surfaces that are structurally unsound or unsafe to work on

  • Work areas that are inaccessible or have not been adequately prepared by the Customer

  • Threatening, intimidating, or abusive behavior toward our team

If a service cannot be completed due to any of the above conditions, a trip fee or partial charge for work already completed may apply.


XI. Cancellations and Rescheduling

Notice Requirement

We require at least forty-eight (48) hours' notice to cancel or reschedule a project start date. Notice must be provided via phone call, text, or email.

Cancellation Fee

Failure to provide the required notice may result in a cancellation fee. If materials have already been purchased specifically for your project, the cost of those materials may be charged to the Customer. These terms will be communicated at the time of the estimate.

Deposit Refunds

Deposits are refundable if cancellation is received at least forty-eight (48) hours before the scheduled project start date. Deposits are non-refundable for cancellations received within forty-eight (48) hours of the scheduled start.


XII. Access and Property Entry

Property Access

By scheduling a service, you grant our representatives and subcontractors access to your home and the areas designated for painting to perform the scheduled work.

Security Systems and Alarm Codes

If your home has a security system or alarm, please provide access codes or disarm instructions before work begins. Please notify us immediately of any code changes during the project.

Keys and Access

If a key, code, or lockbox is provided to allow access during the project, Major Scale Painting is not responsible for any loss or damage resulting from access provided via an unsecured method. Any keys in our possession will be returned upon project completion or within forty-eight (48) hours of project end.

Pets

Please secure all pets away from work areas for the duration of the project. Open paint containers and equipment present hazards for animals. We are not responsible for pets that enter work areas, or for any injuries sustained by our team due to unsecured animals.


XIII. Hazardous Materials

Lead Paint

Homes built before 1978 may contain lead-based paint. If lead paint is present or suspected, the Customer must disclose this prior to the start of work. We comply with applicable EPA Renovation, Repair, and Painting (RRP) rules where required. We reserve the right to halt work if undisclosed lead paint is discovered.

Mold and Water Damage

If mold or active water damage is discovered on surfaces during the project, we will notify the Customer immediately. We do not paint over active mold or water-damaged surfaces. If such conditions are discovered, affected areas may be excluded from the scope of work pending remediation by a qualified contractor.


XIV. Property Damage, Breakage, and Loss

Our team takes reasonable precautions to protect your home on every project. All work is performed by trained professionals and backed by general liability insurance.

Any property damage must be reported within forty-eight (48) hours of the relevant work being completed, via phone, email, or text.

Limited Liability

We are not responsible for damage caused by pre-existing conditions including surfaces with poor adhesion, prior paint failures, water damage, or structural deficiencies not disclosed prior to the start of work. We are not liable for damage to items left in work areas that were not removed or covered as outlined in Section VI of this Agreement.

Color and Finish Variations

Natural lighting conditions, texture, and surface porosity can cause paint colors to appear differently than swatches or digital samples. Minor color variation between coats or between painted and unpainted surfaces is inherent to the painting process and does not constitute a defect in workmanship.


XV. Insurance

Major Scale Painting carries general liability insurance covering potential damages or injuries that may occur during the provision of our services. A certificate of insurance is available upon request.


XVI. Subcontractors

We may engage independent subcontractors to assist with painting services. Subcontractors are vetted and held to the same professional standards as our direct team members. We take responsibility for the quality of work performed by subcontractors to the same standard outlined in this Agreement.


XVII. Non-Solicitation

During the term of this Agreement and for a period of one (1) year following its termination or expiration, you agree not to solicit, hire, or attempt to induce any employee, subcontractor, agent, or affiliate of Major Scale Painting to terminate or reduce their relationship with our Company for the purpose of working directly for you. Violation of this provision may result in a placement fee to cover recruitment and training costs.


XVIII. Modification and Assignment

This Agreement and your obligations under it may not be assigned, transferred, or modified without prior written consent from an authorized representative of our Company.


XIX. Website Usage

Our website is provided for the purpose of obtaining information about and scheduling our services. All use must be lawful. The following are prohibited:

  • Downloading, copying, or reproducing website content without permission

  • Using data mining tools, bots, or automated extraction software

  • Using framing, deep linking, or other navigational manipulation

  • Registering, subscribing, or unsubscribing any person without their authorization

  • Using the website or its content for any purpose other than its intended use

  • Harassing, threatening, or engaging in abusive behavior toward our Company, team, or customers

  • Infringing on our intellectual property rights or those of our customers

  • Interfering with or disrupting our website, servers, or security systems


XX. Indemnification

You agree to indemnify, defend, and hold harmless Major Scale Painting, its owners, officers, employees, agents, and subcontractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or connected with your use of our website or services, your violation of this Agreement, or your violation of any rights of another party.


XXI. Limitation of Liability

To the fullest extent permitted by law, Major Scale Painting shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of our website or services. Our total liability for any claim under this Agreement shall not exceed the total amount paid by the Customer for the specific service giving rise to the claim.


XXII. Force Majeure

Major Scale Painting shall not be held liable for delays or failure to perform services due to circumstances beyond our reasonable control, including but not limited to severe storms, tornadoes, flooding, power outages, pandemics, government orders, or other acts of God. In such cases, services will be rescheduled as soon as reasonably practicable.


XXIII. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to conflicts of law provisions. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.


XXIV. Electronic Signatures

This Agreement and any documents delivered in connection with it may be executed electronically. Electronic signatures are recognized as legally equivalent to handwritten signatures for purposes of validity and enforceability.


XXV. Entire Agreement

This Agreement constitutes the entire agreement between Major Scale Painting and the Customer regarding the subject matter hereof and supersedes all prior or contemporaneous communications and proposals, whether oral, written, or electronic.
